Terms and Conditions for Services
By selecting the box you agree to the following Terms and Conditions of this Service.
You - being the client and receiver of the service.
The Service - being the Homeopathic Consultation or Package or Subscription selected by you as offered and provided by Fruition Mind Body Health and it’s homeopathic employees including any time taken to consider the information given by you to Fruition Mind Body Health to conclude the Prescription.
Fruition - being Fruition Mind Body Health the business offering The Service.
Payment Plan/Subscription - being any reoccurring payment option for selected Services offered by Fruition Mind Body Health under Packages and Subscriptions on the Fruition Mind Body Health website for an ongoing or a fixed period of time.
Fee - being the amount payable for The Service and any other products purchased by you from Fruition, including but not limited to Homeopathic Remedies, Supplements and Hair Tests. Includes all instalments for any Payment Plan option.
Payment - being the payment by cash, direct deposit or Stripe or any other payment gateway for The Service and any other items purchased from Fruition.
Homeopathic Remedies - being the homeopathically prepared remedies which are prescribed and purchasable from Fruition and which the cost of is exclusive of the Appointment Fee. The price of any of the Homeopathic Remedies can be found on fruitionmindbodyhealth.co.nz/shop.
Prescription - being the homeopathic remedies and/or supplements and/or other health items or lifestyle changes recommended by Fruition on completion of The Service.
1. The Service you select is the Service that Fruition will provide to you to the best of it’s ability.
2. The particular details of The Service you have selected are available on the confirmation page when booking The Service. If you require more information before you book The Service, please contact Fruition first.
3. Fruition will provide The Service to the best of its ability for the Fee. The details of the particular Service and what is included are set out in the booking process.
4. You agree that you understand what is included in The Service.
5. You agree that you will make payment for The Service you have selected before or directly after the appointment, or within 3 working days of receiving an invoice for The Service and any items you may have purchased from Fruition including but not limited to Homeopathic Remedies, Supplements and Hair Tests. If The Service you have selected is a Subscription/Payment Plan you agree that you will pay each instalment for the Payment Plan/Subscription at the time it is due and you will pay all instalments due under the Payment Plan/Subscription within the fixed term of the Payment Plan/Subscription term.
6. You understand that the cost of any Homeopathic Remedy prescribed to you is not included in the Appointment Fee and is a further cost to you.
7. You understand that Fruition does not require you to purchase the Homeopathic Remedy or Remedies prescribed to you from Fruition, and that purchase of any item other than The Service is at your discretion.
8. You understand that if you do not make payment of the total amount within 3 working days of the invoice, you will receive a reminder invoice. If you do not make payment on the reminder invoice within 10 working days of receipt, you will be sent a letter requiring payment to be made within 30 days. If you do not make this payment within 30 days the matter will be referred to a Debt Collection Agency.
9. Payment Plans/Subscriptions will be cancelled immediately on non-receipt of payment of any instalment. Should you offer a valid reason to Fruition for the non-payment of the instalment, then Fruition at its own discretion may reinstate the Payment Plan with further terms as to the unpaid amount/s. Should no reason be given or Fruition decides that any reason given by you is not valid, then Fruition will take action under Clause 8. of this agreement for any outstanding portion of the Subscription/Payment Plan where The Service has been partly or fully completed.
1. If Fruition is unable to provide The Service to you, Fruition agrees to refund you any payment made or retain the payment for a future Service as per agreement with you.
10. If you are unable to make the time of the appointment for The Service, you agree to let Fruition know no less than 12 hours before the time The Service is due to begin. Failure to do so will require you to be liable for up to 50% of the Appointment Fee at the discretion of Fruition.
11. If you fail to arrive at the appointment and have not notified Fruition that you are unable to do so, you will be liable for the full amount of the Appointment Fee. If you have contacted Fruition with 12 hours of the start time of The Service and have legitimate reasons for not making the appointment, Fruition may at it’s discretion decide not to require full payment from you.
12. Following the appointment you will be provided with a prescription for Homeopathic Remedies and any other item or lifestyle change Fruition deems relevant to help you improve your symptoms. Fruition will not be liable for any failure on your behalf to follow the prescription in accordance with the information sent to you following The Service.
13. Following your appointment you will be sent information on how to keep and store your remedies and what to expect after you have take the Prescription. You agree that you have/will read this information and if you do not understand it will contact Fruition for clarification. Fruition will not be liable:
a) for any damage, fault or spillage of any remedy once it is received by you if you do not adhere to the care directions for that remedy set out in the information Fruition
b) for any negative outcome related to any failure to keep Fruition updated as to your progress in accordance with the information sent to you following The Service.
c) for any negative outcome if the prescription is not followed by you.
14. You understand that Fruition may require a period of time following the Appointment to complete your Prescription. Fruition will keep you informed as to the progress of your Prescription if it is to take longer than one to two days.
15. You agree that the information you have provided Fruition is correct and true and Fruition is not liable for any negative outcome as a result of omitted information or untrue information received by you.
16. You agree that the remedies may not have an alleviating effect on the symptoms you have come about and you understand that you may need to work with Fruition for longer to improve your health.
17. You understand that despite the best efforts of Fruition you may not have a satisfactory response to your Prescription.
18. You understand that all and any information you have given Fruition is confidential and that Fruition will hold such information safe for you during treatment with Fruition and indefinitely following such treatment. Your files will be destroyed after 10 years if no further contact is made with Fruition in accordance with the laws of New Zealand.
19. You indemnify and hold harmless Fruition and it’s respective employees and officers of any claims, losses, damages, liabilities, penalties, punitive damages, expenses, reasonable legal fees and cost of any kind or any amount whatsoever you have incurred as a result of claims by another homeopath or homeopathic agency about the curative effect of homeopathic treatment or by not following the prescription and advice given to you as part of The Service, The Prescription and according to these Terms and Conditions.
20. You agree that you are over the age of 18 years or are the caregiver for the person under 18 years of age you are making the appointment for. You agree that you are legally sound of mind and able to agree to these Terms and Conditions on your or their behalf.
